NOTE:

A. The following Terms and Conditions contain assumptions of risk and/or liability by the Customer and limit and exclude liabilities, obligations and legal responsibilities which Mobile Telephone Networks (Proprietary) Limited, Registration Number 1993/001436/07 (“MTN”) will have towards the Customer and other persons. These Terms and Conditions also limit and exclude the Customer’s rights and remedies against MTN and place various risks, liabilities, obligations and legal responsibilities on the Customer. These Terms and Conditions may result in the Customer being responsible for paying additional costs and/or amounts and MTN may also have claims and other rights against the Customer.

B. To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (the “Consumer Protection Act”), no provision of the Terms are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.

C. Please read these terms and conditions carefully. Participation in this service will constitute an agreement by the Customer to comply with these Terms and Conditions. If the Customer does not agree with these Terms and Conditions, the Customer should not participate in this service.

E. Privacy Policy & Notice

SECTION 49 CONSUMER PROTECTION ACT NO 68 of 2008 NOTICE, THE FOLLOWING TERMS ARE IMPORTANT TO NOTE: 1,2,3,4

1. Introduction
   1. The voucher product is provided by MTN (“Voucher/Service”).
   1. Any reference to MTN shall mean any website, application or contact point used by MTN in the facilitation of the Service.
   1. The Service will be available on MTNs’ platform from (25 January 2021 until MTN in its sole and absolute discretion elects to discontinue the Service
   1. By purchasing a voucher, you agree to the following terms and conditions. Please read these terms thoroughly and carefully before using the service.
   1. Any reference to “we”, “Us”, and “Our” shall refer to MTN, Its affiliates and/or its third party service providers for the service.
   1. Voucher is available to all MTN customers
   1. Vouchers (upfront sales) can be taken by you in different denominations as determined by us and displayed on MTNs’ approved platform and on the voucher.
   1. The vouchers will be offered for purchase from different vendors on MTNs’ approved platform, which can be used at the vendors physical or digital outlets only.
   1. All vouchers are valid for the respective period indicated on MTNs’ approved platform and on the voucher from the date the voucher is disbursed to you.
   1. The Service is available for upfront sale as per clause 2 below. Please read the clause carefully and thoroughly.

• Upfront sales
  • You can choose the “buy now” option on MTNs’ approved platform where you can purchase an immediately redeemable digital voucher, once issued, for use at the selected vendors outlet.
  • Payment is due and payable immediately upon purchase of the voucher
  • You authorize us to collect the amount payable from your bank account per the card details or store of value details entered on MTN’s approved platform.

• Indemnity
  • You agree to indemnify and to hold us harmless from any and all claims, demands, losses, liabilities, and expenses (including legal costs) arising out of or in connection with.
    • The use of the service or goods obtained through the use of the service;
    • Breach or the violation of any of these terms and conditions;
    • Our use of data; and/or
    • Violation of the rights of any third party, including our third-party service providers.
• Use of the service
  • The service can be taken up by you directly using MTN’s approved platform, available at www.mtnplay.co.za
  • Provision of the service will involve the processing of your personal information. By you, as a customer, using the service you accept that your personal information (i.e. MSISDN on MTNs’ approved platform) can be collected and processed by MTN and its appointed third-party for the service.   • MTN has the right to change to modify these terms and conditions at any time with the method of notice determined by MTN
